Welcome to CallARide (“CallARide”, “we”, “us”, or “our”).
These Terms and Conditions (“Terms”) govern your access to and use of the CallARide mobile application, website, and related services (collectively, the “Service”) within the Republic of Malawi.
By registering, downloading, or using CallARide, you agree to comply with and be bound by these Terms. If you do not agree, please do not use the Service.
1. About CallARide
CallARide provides a digital ride-hailing platform that connects passengers (“Riders”) with independent third-party drivers (“Drivers”) who offer transportation services using their own vehicles.
CallARide:
- Does not own vehicles,
- Does not employ Drivers, and
- Is not a transport service provider.
Each Driver operates independently and is responsible for compliance with Malawi’s Road Traffic Act and all other applicable regulations.
2. Eligibility
To use the CallARide Service in Malawi, you must:
- Be at least 18 years of age.
- Have legal capacity to enter into a binding contract.
- Provide accurate and truthful registration details.
- Comply with all local laws, including traffic and safety regulations.
CallARide reserves the right to verify your identity and reject or suspend accounts for false or incomplete information.
3. Account Registration
- You must create an account with valid contact information (full name, phone number, email, and payment method).
- You are responsible for maintaining your account confidentiality.
- You must not share or transfer your account to another person.
- CallARide may suspend or terminate accounts found engaging in misuse or fraud.
4. Use of the Service
You agree not to:
- Use the platform for any unlawful or fraudulent purpose.
- Harass, harm, or discriminate against other users.
- Interfere with the platform’s security or performance.
- Copy, modify, or reverse-engineer the software.
Violation of these Terms may result in immediate suspension or permanent deactivation.
5. Ride Requests and Fares
- When you request a ride, the system matches you with an available Driver nearby.
- Fares are calculated automatically based on distance, duration, and prevailing demand.
- Once a ride begins, you are responsible for full payment of the fare displayed in the app.
- CallARide may adjust fare estimates due to route changes, waiting time, or additional fees (e.g., tolls).
All fares are denominated in Malawi Kwacha (MWK).
6. Payments and Receipts
- Payments may be made via mobile money, credit/debit cards, or cash, depending on availability.
- Digital payment information is processed securely in line with Malawi’s Electronic Transactions and Cyber Security Act (2016).
- CallARide issues electronic receipts for completed rides via the app or email.
- Drivers receive trip payments less a service commission charged by CallARide.
7. Cancellations and Refunds
- Riders may cancel a trip before pickup, but a cancellation fee may apply.
- Refunds (if any) are processed according to our Refund Policy, available in-app.
- Refunds are not guaranteed once the trip has started or completed.
This complies with the Malawi Consumer Protection Act (Cap 48:10), which allows service providers to charge reasonable administrative costs for cancellations.
8. Safety and Conduct
For the safety of all users:
- Drivers must have a valid driver’s license, vehicle insurance, and roadworthy certification.
- Riders and Drivers must behave respectfully and follow all safety laws.
- Use of alcohol, drugs, or offensive behavior during a trip is strictly prohibited.
CallARide may suspend accounts for misconduct or safety concerns.
9. Data Protection and Privacy
CallARide collects and processes your personal data in accordance with:
- The Malawi Data Protection Guidelines (2021); and
- The Electronic Transactions and Cyber Security Act (2016).
Data Collected:
- Account details (name, contact info, profile photo).
- GPS location (to connect Riders and Drivers).
- Trip history and payment data.
- Device and app usage analytics.
Data Use:
- To provide and improve our services.
- To process payments and generate receipts.
- To ensure user safety and comply with legal obligations.
Your personal data will not be sold to third parties.
You may request access, correction, or deletion of your data by emailing: callaride@callaridemw.com.
10. Consumer Protection
Under the Consumer Protection Act (Cap 48:10), you have the right to:
- Receive services of satisfactory quality.
- Access accurate information about fares and service terms.
- Lodge complaints or seek redress for unfair treatment.
CallARide maintains a Customer Support Desk to handle complaints in a fair and timely manner.
11. Limitation of Liability
To the fullest extent permitted under Malawian law:
- CallARide is not liable for any accidents, losses, injuries, or damages arising from transportation services provided by independent Drivers.
- Drivers are solely responsible for their actions, conduct, and compliance with road laws.
- Our liability for any claim will not exceed the total fare paid by the Rider for the disputed trip.
12. Intellectual Property
All trademarks, logos, software, and content on the CallARide platform are owned by or licensed to CallARide.
Users may not copy, modify, or distribute such content without prior written permission.
13. Suspension and Termination
We may suspend or terminate your account if:
- You breach these Terms.
- Engage in fraud, abuse, or unsafe behavior.
- Provide false information or misuse the platform.
You may close your account at any time by contacting callaride@callaridemw.com.
Pending balances or obligations must be settled before closure.
14. Updates to the Terms
CallARide may amend these Terms from time to time to reflect changes in the law or business operations.
The updated version will be available in-app or on our website, with a revised “Effective Date.”
Continued use of the Service implies your acceptance of the revised Terms.
15. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of Malawi, including:
- The Consumer Protection Act (Cap 48:10);
- The Electronic Transactions and Cyber Security Act (2016); and
- Any other relevant statutory instruments.
Disputes shall be resolved through amicable negotiation or, if necessary, submitted to the competent courts of Blantyre, Malawi.
